Making Money With Options

Evan Jowers here, with a quick post before the New Year holiday. As you know from our recent posts, Robert Kinney and I have continued our pattern this year of traveling to Hong Kong / China to meet personally with clients and learn of openings (six trips each this year – ouch). Alexis Lamb of course is permanently based in our Hong Kong office and Yuliya Vinokurova travels to Asia periodically from her base in Russia. As a result of our availability to firms and more importantly our success in placing more US attorneys in Asia than any other recruiting firm, we are on top of many US associate openings at present in Hong Kong/China.

As you know from recent posts, we have many current openings for Mandarin fluent cap markets and M&A US associates (too numerous to list here). As the year winds to a close, we wanted to list in one place a description of some of our more unusual openings for US associates at top US and UK firms in Hong Kong / China:

Hong Kong – native Korean fluent private equity fund formation US associate; 2 to 5 years experience

Shanghai – native Mandarin fluent IP transactional US associate; mid to senior level

Hong Kong or Singapore – US securities / high yield / M&A mix US associate (English only ok); 4 to 7 years experience (the successful candidate will have his/her choice of Hong Kong or Singapore location)

Hong Kong – native Korean fluent private equity M&A US associate; 2 to 6 years experience

Hong Kong, Beijing or Shanghai – native Mandarin fluent US senior capital markets associate for counsel or partner role (several openings); very senior associate with top firm experience in China and NYC preferred

The US and UK biglaw associate lateral hiring market in Hong Kong / China continues to pick up. We are expecting a mini-boom of US associate hiring in Hong Kong, Shanghai, Beijing, and Singapore during the first quarter of ’11. The reason is twofold: a) Hong Kong / China has been a very busy market for more than a year now and most firms are understaffed; and b) numerous US and UK firms in Hong Kong / China have, for the first time since mid ’08, a full “green light” from their global firm management to make US associate lateral hires.

Some of our clients, for example, were able to make one hire here and there during ’10 in Hong Kong / China, but were not able to obtain a full green light to hire as needed by any means (getting clearance from firm management to make each hire was understandably a long process, due to the still shaky US and Europe markets). Recently, some of these firms have been given clearance to hire multiple US associates in Hong Kong / China, in some cases as many as 7 to 10, with most top US and UK firms planning to hire at least 2 in early ’11. While the hiring markets in US and Europe are still shaky, firms’ global management can no longer ignore the long run of heavy deal flow in Hong Kong / China and their offices and partners in the region being understaffed. Naturally, in an end of calendar year period, where budgets for the following year are figured out, the full green lights for Hong Kong / China lateral hiring are coming in bunches recently.

The interview process in ’10 in Asia has been mostly long-winded due to the abundance of great candidates on the market, most firms having to go through a long process internally to get clearance to give an offer, and firms knowing their competitors are also not moving quickly with offers. In the first quarter of ’11, we are expecting firms in Hong Kong / China to move a lot quicker with US associate hiring process and also be a little less selective because of the larger number of openings putting pressure on the market. Some partners have had serious staffing pressures throughout ’10 and they are going to want to hire quickly now that they have the clearance to do so.

Paying for Android apps is easier for AT&T users as the operator is adding carrier billing for its Android device owners. Users who find an app they like in Android Market will have the option of having the software purchase tacked on to their monthly bill, rather than go through Google Checkout. The update brings a much needed payment alternative to Android Market and hopefully points the way to carrier billing support from all carriers soon.


Right now, a lot of people don’t buy apps from Android Market because they’re limited to Google Checkout. Besides being flaky for some users, Google Checkout requires new users to enter in their credit card information. It’s a step that turns people off and has been hurting paid downloads on Android Market compared to iTunes, where many users already have their credit card on file with Apple.


What people really want is to just add purchases to their carrier bill. A new Strategy Analytics survey found that 38 percent of consumers prefer carrier billing more than pre-registered accounts like iTunes and PayPal, which are tied for 31 percent. Credit or debit card entry is favored by 22 percent of users.


This is important for Android and its ecosystem of developers. Options like PayPal are also welcome but the easiest thing to do for a consumer is just tack it on to their bill. T-Mobile has previously supported this and Sprint announced last year that it would, though it hasn’t followed through. Verizon Wireless supports carrier billing for app downloads in its VCast App store but there’s no word when it will be come to Android Market. Google’s Eric Chu said Google will continue to partner with more carriers on carrier billing so hopefully we’ll see Sprint and Verizon at some point soon.


Overall, it’s another sign that Google is making significant efforts to address some of the problems in Android Market. Recently, Google overhauled the look of the Android Market, making it easier for people to browse content using more categories and additional tools such as finding related apps. For developers, Google has upped the size of apps to 50MB, reduced the refund window to 15 minutes and earlier this year, opened up sales overseas to more countries. There’s still more to be done. I’ve asked about that promised online Android Market storefront. But gradually, Google is getting the picture. Android developers need to be able to make money and giving them tools to do that will help the entire ecosystem flourish. Mobile ads and in-app purchases are important monetization pieces but paid downloads are key for many developers looking for a return on their work. Expanded carrier billing could be an essential piece in helping Android developers close the revenue gap on their iOS counterparts.

Making Money Ideas

2010 is winding down rapidly with all indications that the worst is behind us – hopefully. At the very least, that’s the sentiment of many of the executives we deal with.


As we gave forward into 2011, we queried several of our executive search partners around the world to get their input on what they see happening in their back yards and what they anticipate for the year to come. Here’s what they had to say:


Sean Carroll, Polachi (NYC)

“If there is any meaningful uptick in the economy, good talent that may be on the sidelines will be gone and entrepreneurs will have a tough time hiring on their own.  Also, I suspect there will be a strong M&A market as we’ve seen with Netezza, Unica, Coremetrics, etc.  Corporations have lots of cash and will buy at the right price.”


“Lastly, as entrepreneurs pioneer innovative solutions, there will always be a shortage of skills as the experience or domain does not exist yet.  A good example is SEO products.  Automating SEO is an interesting problem to solve but there are only a few young product companies, so the only place to get SEO experience is the agencies…no SaaS or product experience there.  Entrepreneurs need to make bets that talent can step up in a new sector.”


Andy Price, Schweichler, Price, Mullarkey and Barry (Silicon Valley)

“My view is that the talent pool is getting snapped up pretty fast and once again we’re seeing a very competitive landscape for people.  We’re competing against two forces: Other companies recruiting, and inertia driven by either risk aversion or someone’s low priced options are suddenly in the money and they’re inclined to take risk off the table.  That said, people believe startups have a chance again so they’re willing to talk to you.  Closing people is the hard part right now.”


Steve Lavelle, Gillamor Stephens (London)

“In Europe, access to the talent pool is there, provided the company’s proposition is compelling enough. Closing candidates can be challenging though and having been through the low point of hiring activity, it’s only going to heat up as we move into next year.”


Sal Rocco, Stonewood Group (Toronto)

“We are seeing more product development, engineering-oriented searches than in the past 2-3 years.  The only thing we can attribute this to is that when the market tanked and companies were cash strapped, the focus was on revenue generation and selling what we had.  They gutted costly product development and engineering teams.  The thought was: Don’t worry about new product development because we may not be alive in 2-3 years if we don’t get cash today.


“To the extent they were doing searches in the past 2-3 years, the searches were on either outward looking sales & marketing types focused on making money or CFOs/Finance types focused on raising cash or slowing the bleed. Today, as the future looks brighter and companies realize that their products are dated, they need to hire engineering leads and product development types, which they were laying off over the past 2-3 years.”


So, for 2011 the future looks fairly bright. VCs are investing and companies are hiring.  A few things entrepreneurs can expect to see and look out for are the following:



  • Senior talent is getting scarce again

  • Social media works for staffing at many levels, but not at the executive level

  • Cleantech continues to march on – and more opportunities will be there for investors

  • Venture capital is emerging from a difficult stretch, but there is money for good ideas and strong teams in mobile applications, gaming and health care IT

  • Candidates want cash and equity.

  • Acquisitions will provide the bulk of exits in 2011; the IPO market isn’t here yet.

Making Money With Website


DHS relied on bizarre legal reasoning and crappy evidence to seize "pirate" domains





Techdirt's Mike Masnick enumerates the litany of crappy law, evidence, and assumptions behind the
Department of Homeland Security's decision to seize a group of music-blog and search-engine domains. The
seizures were backed copyright industry lobbyists. The story should scare all of us: if you have a
.com or .net domain, the US government is prepared to censor you on the evidence-free say-so of
a corporate lobbyist from the copyright cartel.



It looks like the four blog/forum sites (RapGodFathers, OnSmash, Dajaz1 and RMX4U) and Torrent-Finder were all lumped together into a single warrant and affidavit. The affidavit was written by a Special Agent with ICE, named Andrew Reynolds, who indicates in the affidavit that he only recently graduated from college (he notes that he's only been on the job for one year, but before that he was a "student trainee with the group"). Much of the affidavit relies heavily on the MPAA. This fits with what ICE assistant deputy director Erik Barnett said soon after the seizures, admitting that they basically just took what sites Hollywood said were a problem and seized them...



...In other words, the "support" that Agent Reynolds provides for why Torrent-Finder's domain should be seized is that he claims that Torrent-Finder's admin linked directly to infringing material. But that's not true. Instead, the admin was simply pointing to a bunch of different news stories. Even worse, some of those news stories highlight why the claims of the MPAA, which Agent Reynolds relies upon, are simply made up -- such as TorrentFreak's story about comic artist Steve Lieber (which was actually based on a Techdirt story about how Steve Lieber embraced the so-called "pirates" and ended up making a lot more money -- we later interviewed Steve about his experiences). The CNET article is all about the COICA law -- which is about the legality of seizures like this one. How is that evidence of probable cause?


Even going beyond the fact that Agent Reynolds can't seem to figure out that a search engine is different than a torrent tracker or a torrent hosting site, he also seems to think that linking to blog posts like the ones we write here is probable cause for criminal behavior. Holy crap! That's just downright scary.

Online campaigns help provide clean drinking water, food and malaria-preventing bed nets to people who need them.

Creative uses of the web are helping to provide and enhance education. These four projects, for instance, found innovative ways to help build schools through digital campaigns.

1. Epic Change

Epic Change has become a model for raising money using social media. Since 2008, its annual TweetsGiving has asked people to tweet about what they’re thankful for while making a donation. The strategy was so successful that #tweetsgiving became a trending topic on Twitter during the first year’s campaign.

Starting out, the benefactor of TweetsGiving was a school in Tanzania that was founded by Mama Lucky Kamptoni, a passionate local woman who started the school using money she earned from her poultry business (now there are two more benefactors). Epic Change wanted to help her rebuild and expand the school.

The organization also launched To Mama With Love, a website where users can make a donation by creating a “heart space” for a mother they care about. The “heart space” is a collection of photos, videos and words dedicated to that mother. Other people who care about that mother are invited to donate in her honor.

From one of the classrooms that was built using donations from these campaigns, the students now tweet and connect with the rest of the world.

“So often, we hear the stories of children in the so-called ‘developing’ world from the perspective of the media, non-profits or friends who have traveled or volunteered,” explains the Epic Change Blog. “What happens now – when these students can share their own stories, and build relationships with the rest of the world, for themselves? How will the world be different when these children, who live so geographically far away, move into our virtual backyard? What difference will it make in their lives to know that their voices will be heard?”

2. Stillerstrong

When Ben Sitller launched the Stillerstrong campaign on YouTubeclass="blippr-nobr">YouTube, Twitterclass="blippr-nobr">Twitter and a branded website, he did it with a video that poked fun at Lance Armstrong’s Livestrong campaign. It was hard to tell if he was kidding.

But the campaign, which sells Stillerstrong headbands and accepts donations by text message and credit card, has raised about $300,000 to help provide temporary schools for Haitians displaced by January’s earthquake. At the time the campaign was announced, the organization and its partners Causecast and the Global Philanthropy Group were expecting each school to cost between $45,000 and $55,000.

3. TwitChange

Instead of auctioning off celebrity memorabilia to support a charity, TwitChange hosts eBay auctions for celebrity Twitter interaction. The donation’s bidders put down to have a celebrity follow them, retweet their tweet, or mention them in an update. The proceeds go to aHomeInHaiti.org, which will use them to build a home and school for children with disabilities in Haiti.

The first auction in September raised $531,640.25. The website instructs us to “stay tuned for the celebrity tweet auction coming this holiday season.”

4. University of the People

Less of a “campaign” than a full-blown effort to democratize education, University of the People provides tuition-free higher education through an online campus.

Since launching last year, the university has accepted about 700 students from 100 different countries to its three- to four-year programs for business and computer science. Recently the university opened computer centers in Haiti so that students with limited Internet access could enroll in its courses.

“I do believe that if we take the millions of people around the world who could not afford going to university and teach them tuition free, we’re not only changing their lives, and their family’s lives, we also change their communities, their countries,” founder Shai Shai Reshef says. “And if we have a lot of them, we will change the world for a better world.”

Making Money Ebay


Gaming companies have become entrenched on Facebook’s platform, while non-gaming apps have for the most part not broken through. But a new group of more practical, utility-like apps is starting to emerge.


In the last few months, we’ve seen a spate of Facebook-connected job hunting sites, professional referral services and e-commerce apps launch and raise money.



Facebook investor Accel Partners recently backed e-commerce startup Yardsellr in a $5 million round and chipped in on a $6 million Series A for job search startup BranchOut. Another company, Stik, which helps users find lawyers and realtors based on the social graph, also opened to the public last month. And Kleiner Perkins Caufield & Byers recently launched a $250 million social fund on the premise that all industries will be redesigned from the ground-up around people’s relationships.


“Any kind of interaction where a person is making decisions based on trust is an area where Facebook can help facilitate,” said Nathan Labenz, who co-founded Stik, a site where people can log on with Facebook and pull up mortgage brokers or lawyers connected to friends.


Yet, three years on, Facebook’s platform essentially has only three breakout areas — gaming, marketing and local group deals. Third-party Facebook integrations are promising and widespread, but cosmetic. The company’s popular social plug-ins help users find content shared by friends, but have yet to fundamentally alter the experience of reading a news site, for example. Most of the startups that came out of Facebook’s fbFund incubator haven’t seen broad traction outside of successes in social media marketing space like Wildfire Interactive.



Labenz says that unlike social games, many of these applications rely on making two-sided markets and Facebook has only just become a truly mainstream product with north of 550 million users — enough to support critical mass for these types of services.


On top of that, viral channels were well-suited to push notifications about daily use apps like social games. Apps designed around rare but high-value situations would get crowded out, he said.


Facebook has since pared down viral channels over the last years, making it harder for non-gamers to hear about new games. It also simplified its graph application programming interface, giving developers a more consistent way to access a wide range of user data from photos to events and people.


“It’s not surprising that games would pioneer use of the platform,” said Daniel Leffel, an eBay veteran who founded Yardsellr. “I definitely am somebody who views what’s happening with Facebook as the beginning, not the peak.”


His company is an online marketplace that uses Facebook to connect buyers and sellers. “Commerce is inherently a trust-driven exercise and having a real identity tied to a Facebook profile lends itself to this really well,” Leffel said.


All this morning, I kept seeing a video of ALF pop up on my Tumblr and Twitter news feeds. Of course, I didn’t click on them because…y’know, ALF…but I totally should have. The video is outtakes from the series ALF in which you can hear the character’s creator and puppeteer, Paul Fusco, entertaining the folks on set by saying some truly offensive things. Serves me right for assuming it was mere needless nostalgia.


The tape was discovered by YouTube user biohazardgraphics who claims he bought it off eBay 10 years ago. He or she posted it on YouTube a year ago where it went without much impact until earlier today when Badtvblog discovered it and brought it to the world’s attention. Hooray! Now we can all enjoy ALF saying the N-word and making filthy come ons to the Tanner’s teenaged daughter!


It’s pretty amazing. But, for my money, the best foul-mouthed outtakes from a dearly missed TV series remains the “dirty takes” from Better Off Ted’s insult episode. Oh. And this, of course.

Making Easy Money

The Federal Reserve is America's Fourth Branch of government and Ben Bernanke is, in effect, the economic czar of the country. The Fourth Branch? The Fed and the Fed alone has the power to determine how much money should be in the economy. Such vast power over our lives makes the Fed a de facto fourth branch of government. Yet, its powers are not defined by the Constitution, and neither the chairman nor senior officials are elected by the people.



The seven Fed governors are appointed by the President, and confirmed by the Senate, for 14 year terms. The chairman of the Fed is appointed to his office for four years, and presidents have been more likely to re-appoint chairmen than not. Alan Greenspan's tour of duty lasted almost 18 years. Dr. Bernanke is in his second term. Perhaps one might be carried away with such power if one had it.

While the popular meme is that the Fed is owned and controlled by the "banks," they are, de facto, completely controlled by the federal government and history shows that no Fed has ever bucked the administration in power. In effect their "independence" has been co-opted by the government.



Should one institution or one man have such vast power over the economy? I don't believe so. This article is not about how to do away with the Fed (though I believe there are better ways to deal with monetary policy), but rather how easily we have accepted the Fed's status as The Great Regulator and its power to centrally plan the economy. For, when you analyze its functions and its mandate to keep prices steady and maintain full employment, that is central planning. And that is power.



And, they haven't done a very good job at it. Yet it is obvious from listening to Chairman Bernanke that he and the rest of the Fed's 19,000 employees believe they do control the economy. In reality all they really do is cause the boom-bust cycles that have been plaguing the economy. Once you understand this then understanding why they have failed to restore the economy from the recession they created is rather easy to see.



Like most economists, the Fed and its chairman mistake their manipulation of money for control of the economy. You and I are the economy and it is quite apparent that the Fed has very little "control" over us. If they could control us, then their policies would have worked and they wouldn't keep experimenting on us with radical policies like quantitative easing and ZIRP.



Money, lest we forget, it just a medium of exchange. It does other things as well (store of value, indicator of the relative cost of things), but its primary function and the reason money was invented is to allow us to easily facilitate exchanges of goods and services. The economy is what we do everyday when we work, buy, sell, and save. Money is just a tool we use. When the Fed manipulates our money what is does is upset our ability to plan about the future. We have one set of perceptions about what money is and then the Fed distorts those perceptions and we end up making bad choices and bad plans. It results in the boom-bust business cycles we have and price inflation or price deflation.



Dr. Bernanke has an exalted status in society and he is treated with deference and is adulated almost everywhere he goes. He has been barnstorming the nation with the purpose of "listening to the people" on how things are going out here. Perhaps these "town forums" he's been holding have been done by other chairmen, but I don't recall that. It reminds me, rather disturbingly, of a political campaign.



Listening to Dr. Bernanke on the "60 Minutes" interview was revealing and at times shocking. I urge you to view the interview, below. Reporters are intimidated by him because of their lack of knowledge of economics. Sunday night's interview was a shameless softballing by the timid reporter, Scott Pelley.



Mr. Pelley should have asked challenging questions. Why aren't Fed policies helping to create jobs? When you say the Fed doesn't "print" money, aren't you being disingenuous since you create money by the stroke of a keyboard? You say the risk of not acting during the crisis in 2008 would have caused another Great Depression as a result of a financial collapse. Do you have any reasonable evidence of that? What basis do you have for saying we would have 25% unemployment without the Fed's $3.3 trillion "rescue." Why are interest rates rising instead of declining as a result of your QE2 policy?  If you believe your policies have helped the economy, why haven't they worked so far? Etcetera ...



I probably disagree with almost everything Dr. Bernanke says in the 60 Minutes interview. It just amazes me that Chairman Bernanke could sit there and say the things he said in light of the Fed's track record. He is totally incapable of admitting that the Fed is the source of our problems not our solutions.
